NO PURCHASE NECESSARY. The Tregaskiss Facebook Promotion ("Promotion") begins November 9, 2011 and ends on November 22, 2011 ("Promotion Period"). The Promotion is sponsored by Tregaskiss, 2570 North Talbot Road, Windsor, Ontario, Canada, N0R 1L0 ("Sponsor"). Void where prohibited. The Promotion is subject to all federal, state, local, municipal and provincial laws.
Eligibility: The Promotion is open to natural persons 18 years of age or older who: (i) have reached the age of majority in their state or province of residence; (ii) are legal residents of the 50 United States or District of Columbia, or Canada (excluding the province of Quebec); (iii) have internet access; and (iv) have a registered profile on Facebook. Sponsor's employees, officers, and directors, and the employees, officers, and directors of Sponsor's parent company, affiliates, subsidiaries, advertising and promotion agencies, and any entity engaged in the production of the Promotion and the immediate families of each, are ineligible to enter the Promotion or win a prize.
To Enter: To enter, during the Promotion Period, visit www.facebook.com/TregaskissWelds and click the "Like" button at the top of the page. After "liking" the page, participants will receive an email from Sponsor with an entry form and instructions for submission. After completing and submitting the entry form in accordance with the instructions provided therewith, participants will be entered into the Promotion. Limit one entry per person. Entries must be fully and accurately completed to be valid. All entries must be completed online and received by 11:59 PM EST on November 22, 2011. Entries submitted by any other means or after the entry deadline may not be accepted. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. Sponsor is not responsible for any problems of any kind with the completion or submission of entry forms, whether mechanical, electronic, or human. Entries that are incomplete, defective, altered, illegible, mutilated, forged or irregular in any way, or not in full compliance with these Official Rules, are void.
Entry through Facebook requires signing up for an account through Facebook, and providing a username/email address and a password. As of the start of the Promotion, there is no charge for an account on Facebook. If you are a first time visitor to Facebook, you will be prompted to complete the on-screen registration form. Registration is a one-time requirement. If you are a returning visitor, you will be prompted to log-in using your email address and/or password. Anyone found to be using multiple accounts to enter may be deemed ineligible. The Promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook. All information provided by a participant in the entry form is provided to Sponsor and not Facebook.
Winner Selection and Notification: A total of fourteen (14) entrants (each a "Selected Entrant") will be selected during the Promotion Period, as follows: at the end of each day during the Promotion Period, one (1) entrant will be selected by a random drawing by a representative of Sponsor. Canadian residents who are selected as the Selected Entrant will be deemed provisional winners and will be awarded prizes subject to the requirements described below for Canadian Winners. Entries from each day will be discarded at the end of the day, after the daily drawing. Odds of winning depend on the number of eligible entries received. Sponsor shall use its reasonable efforts to notify the Selected Entrants by telephone or electronic mail within ten (10) days of drawing.
In the event of a dispute over the identity of the Selected Entrant, the Selected Entrant will be deemed to be the Authorized Account Holder of the email address used at registration or the Facebook account used. "Authorized Account Holder" is defined as the natural person who is assigned to the Facebook account or an email address by an Internet service provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Selected Entrants may be required to execute an affidavit or declaration of eligibility, waiver of liability, and publicity release, which must be returned in accordance with the instruction provided therewith within fifteen (15) days of the postmark to be deemed a winner and awarded a prize. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to deliver the affidavit or declaration of eligibility, waiver of liability, and publicity release to Selected Entrants. If a Selected Entrant cannot be contacted within 15 days of the draw, is ineligible, fails to claim a prize within 15 days of initial contact, or fails to timely return the completed and executed declaration of eligibility, waiver of liability, and publicity release, as required, the prize may be forfeited and awarded to an alternate entrant who will be randomly selected from the remaining eligible entries (or if alternate entrant is Canadian, through the process described below). If a Selected Entrant has updated his/her contact information, it is the sole responsibility of such Selected Entrant to notify Sponsor or its designated agent of any such change. Sponsor is not responsible for the inability to contact a Selected Entrant or lack of any prize deliveries due to change of contact information. Once a Selected Entrant has: (i) been verified by the Sponsor; and (ii) satisfied the foregoing requirements, he or she will be named a winner and shall be eligible to collect the relevant prize.
Canadian Provisional Winners: In addition to the above, in order for a Canadian Selected Entrant to win and received a prize, he/she must first correctly answer, unaided and without mechanical or electronic assistance, a time-limited mathematical skill-testing question administered by email or by telephone. Failure of a Canadian Selected Entrant to correctly answer the skill-testing question in the time allotted will result in disqualification, the forfeiture of his/her interest in the prize, and the random selection of a substitute entrant from among the remaining eligible entries.
Prize: Based on the date of drawing listed below, each Winner will receive one of the following Tregaskiss items:
General Terms: By participating in the Promotion, each winner consents to use of name, image, likeness, and address for Sponsor's advertising, promotional, and publicity purposes without additional compensation, except whereby prohibited by law. All entries become the sole property of Sponsor and will not be returned. By entering, participants agree to be bound by these Official Rules, and hereby release and agree to hold harmless, Facebook, Sponsor, its agents, parent companies, subsidiaries, and affiliates, and each of their respective officers, directors, employees, and agents from any and all liability, loss, or damage arising out of their participation in the Promotion or with respect to the awarding, receipt, possession, use, and/or misuse of any prize.
Sponsor is not responsible for late, lost, incomplete, incorrect, damaged, misdirected entries or prize claims. Sponsor is also not responsible for incomplete, interrupted, or scrambled transmissions, unavailable websites, networks, servers, or systems, or other connection or transmission problems, technical malfunctions of the computer, software, website, or any combination thereof, problems associated with any virus or other damage caused to any participant's system or other problems of any kind, whether mechanical, electronic, or human. Sponsor reserves the right to suspend and/or cancel the Promotion or change any element hereof, with or without notice, at any time.
Personal information collected as part of this Promotion may be shared with Sponsor's promotional partners or the extent necessary to fulfill prizes. Except as otherwise contemplated in these rules or in any publicity release, information collected by Sponsor in connection with this Promotion will be used by Sponsor in accordance with Sponsor's online privacy policy posted at http://www.tregaskiss.com/privacy-policy-p127111. In addition to these Official Rules, entrants agree to be bound by the privacy policy and terms of use of Facebook, which are hereby incorporated as part of these Official Rules.
